Administration asks Supreme Court to bypass appeals courts, take up DACA case

The Trump administration has requested once again that the Supreme Court rule on the legality of the administration's attempt to discontinue the Deferred Action for Childhood Arrivals (DACA) program before a lower court rules on the matter. In a brief two-sentence order in February, the court rejected the government's request "without prejudice" - leaving the government the option to file another petition for review later on, presumably after the 9th Circuit ruled on its appeal.

Beer enthusiast Kavanaugh was on the DC Court of Appeals that decided the case and back then he dissented and argued that the requirement to not block content violated ISPs' First Amendment rights - and so recused himself from the Supreme Court decision.

If the new cases proceed at the Court on the regular timetable and review is granted, they could be heard and decided by the end of the current term late in June.

"USTelecom will continue to support that order from challenges in Washington, D.C. and state capitals", the trade group said.

"Today's decision is not an indication of the Court's views on the merits but simply reflects the fact that there was nothing left for the Court to rule on", the Internet and Television Association said.

The Trump administration and internet service providers had asked justices to wipe away a ruling that had temporarily preserved the Obama-era net neutrality regulations. Sensing that those efforts might succeed, Texas and seven other states filed a separate lawsuit in hopes of having the program declared illegal.

That is the lead case that the Administration appealed to the Justices on Monday.

The legal moves reflected a desire by conservatives and industry players to cement the FCC's repeal of net neutrality rules, which were created to restrict Internet service providers' ability to manipulate loading speeds for specific websites or apps.

The program is keeping about 700,000 young people from being deported, NPR's Joel Rose notes.

The Supreme Court declined to take up a challenge to a set of robust net neutrality rules put in place by the FCC in 2015, but this is by no means the end of the legal thicket over rules of the road for the internet. The change fits with the deregulatory stance of the Trump administration.

"The last administration started DACA without a mandate or even an authorization from Congress or the courts; this administration can therefore end DACA at any time", Attorney General Jeff Sessions said in a statement Monday. His work has appeared here since mid-2011.
