U.K. Top Court Criticizes Strict Northern Irish Abortion Law

Don’t ask Northern Irish women to beg for their human rights with an abortion referendum

In 2015, the High Court ruled that abortion legislation in Northern Ireland did violate human rights under European Union law.

The Supreme Court has ruled that the current law is incompatible with Article 8 of European Convention of Human Rights - that is the right to respect for private and family life - in those three circumstances.

'The need for amendment is evident... the present legislative position in Northern Ireland is untenable and intrinsically disproportionate in excluding from any possibility of abortion pregnancies involving fatal foetal abnormality or due to rape or incest... the present law clearly needs radical reconsideration.

Sarah Ewart, supported by Amnesty, will now be taking this case to the Belfast High Court, seeking the declaration of incompatibility that the Human Rights Commission was unable to obtain.

Britain's Supreme Court on Thursday criticized Northern Ireland's strict anti-abortion laws but dismissed a legal challenge.

"All seven judges have also made clear that they would not have allowed abortion on the grounds of a serious malformation of the unborn child".

Abortion is illegal except where a woman's life is at risk or there is a permanent or serious danger to her mental or physical health.

Abortion laws were relaxed in the rest of the U.K in 1967, but that legislation was never applied in Northern Ireland, which had its own parliament between the partition of Ireland in 1921 and the imposition of direct rule from London 50 years later. "We hope they take it".

For Sinn Fein, Mrs O'Neill said she wanted repeal of the relevant sections of the 1861 Offences Against the Person Act to ensure abortion was no longer treated as a criminal offence in the region.
